Dignidad humana en la era de la inteligencia artificial desafíos jurídicos y tecnológicos del siglo XXI

Este estudio examina críticamente la comprensión jurídica de la dignidad humana en la era digital y los desafíos jurídicos y tecnológicos derivados de la incorporación de sistemas de inteligencia artificial en procesos de decisión que pueden afectar derechos fundamentales. El análisis se basa en literatura científica de Scopus y Web of Science, complementada con fuentes doctrinales, normativas, regulatorias e institucionales de organismos internacionales. Se adoptó un diseño documental cualitativo que combina el análisis jurídico y filosófico desde el constructivismo jurídico y el paradigma de la complejidad. Los resultados revelan tensiones en torno a la autonomía humana, la privacidad, la igualdad, la no discriminación, la transparencia, la rendición de cuentas y la supervisión humana efectiva. A partir del análisis documental, el estudio desarrolla el constructo de dignidad sistémica, entendido como la proyección dinámica de la dignidad humana en entornos sociotécnicos complejos donde interactúan personas, sistemas jurídicos y tecnologías de inteligencia artificial. Este constructo amplía el alcance explicativo y regulatorio de la dignidad humana y respalda marcos regulatorios basados en derechos, adaptativos y multinivel, capaces de garantizar control humano efectivo y salvaguardias jurídicas durante el ciclo de vida de la inteligencia artificial
